Terms and Conditions for entry to Photography Competition jgallery 2010

1)Thankyou for the Music’ is a photographic competition open to all amateur photographers over the age of 18 as of 1st September 2010, except employees of jgallerymoulton their families and relatives, and (except as set out below in this paragraph) anyone else connected with this competition.

2) Entries must be of the United Kingdom of Great Britain & Northern Ireland, the Isle of Man or the Channel Islands.

3) Entries must have been taken within the five years immediately prior to the closing date. Images that have won an award (including winner, runner-up, highly commended, commended) in a national or international competition or that have been entered in such a competition where the results are still pending, are not eligible for entry.

4) All entries must be submitted digitally (scans from film are acceptable) and must be uploaded via photocomp@jgallery.org.uk No entries will be accepted by mail. No digital files will be returned, but all low-resolution images, apart from those short-listed, will be destroyed after the close of the competition.

5) The competition opens on 1st August2010 and the closing date is the 12th Nov 2010 (at midnight BST between the 12th & 13th).

6) Number of submissions

A maximum total of 5 images per entrant may be submitted

The entry fees are as follows:

Up to 1 image: £5.00

Up to 3 images: £13.00

Up to 5 images £20

If you pay for 3 images and submit 3 images, you may submit a further 2 images as a new transaction at a later date, you will have to pay the full £10 for this second submission and second transaction,

7) Initial entry.

Image files should be uploaded to the site as jpegs (72ppi) with 800 pixels along the longest length. When resizing your pictures, please make sure that you do not overwrite your original file. You must ensure that you upload your images the right way round. No responsibility can be taken by the organisers for images that are submitted backwards or incorrectly orientated. Black & white images are eligible for all categories, as are images of panoramic format.

8) File naming protocol.

Please name your digital files with your surname, initial & image number. For example, if your name is Jane Smith and you are submitting 5 images, your numbers would run from smithj01.jpg to smithj05.jpg. Please do not include capital letters, spaces or any other characters in your file names. All images will be cross-referenced, by the organisers, with a unique identifying number, so that the judging is completely anonymous and based on the image alone. When you upload your images, you will be asked for caption information. This will not be used for judging purposes.

9) File sizes.

a) Images from digital cameras or camera phones can be submitted to “Thank you for the Music” and must have been taken using a camera with a sufficiently high resolution to allow the image to be reproduced at A4 size or above (at 300 ppi). We recommend that you use a camera of 4 mega pixels or more.

NB Please ensure that your camera is on its highest-quality setting.

b) Images that have been scanned from transparencies or negatives are eligible. The high resolution scan that will be required for short-listed images should be a minimum of 30mb as an uncompressed tiff file, although a high-quality jpeg is acceptable. (8 bit, Adobe RGB 1998 colour space).

10) Digital adjustments.

Digital adjustments, including High Dynamic Range (HDR) imaging techniques and the joining together of multiple frames, are allowed. However, the integrity of the subject must be maintained and the making of physical changes to the subject is not permitted (removing backgrounds etc, stripping in sky from another image etc). The organisers reserve the right to disqualify any image that they feel lacks authenticity due to over-manipulation.

11) Copies.

Please ensure that you keep copies of submitted images. The organisers will take all reasonable steps to ensure the safe storage and back-up of entries, but cannot be held responsible for exceptional circumstances including Acts of God.

12) Judging.

All entries will be assessed by a pre-judging panel approved by head judge, Nick Elliot, and a shortlist will be announced following the closing date of 15/07/10. All those on the shortlist will be contacted by email and will then have 10 days to supply a high-resolution file. Failure to produce a high resolution file of the correct size (see # 10) within the designated time period will eliminate an entrant from the shortlist. The organisers cannot be held responsible for emails that do not arrive due to the entrant’s email security settings or restrictions placed by their Internet service provider. All winners will be notified by email and the prize presentation ceremony will be held at the jgallery 19th November 2010. A list of the winners will be published on the jgallery website as well as in the press, from November 2010.

12) Prizes.

Amateur class

The entrant, who creates the entry deemed by the judges to be the single best image, will become the jgallery “Thank you for the Music” jgallery amateur photographer of 2010 and will win

General

The organisers reserve the right to change prizes to ones of comparable value if required by

unforeseen circumstances. Any such changes will be posted on the competition website. Prizes

are not transferable and no cash equivalent will be available for non-cash prizes.

Please note that the Forth Bridge walking tour prize can only be offered to those of a good physical fitness. There is no step free access to the bridge structure and

it has considerable amounts of narrow metal walkways and steps.

13) Copyright and permissions.

By submitting images to “Thank you for the Music”, each entrant confirms and warrants that:

a) they are the sole author of each entry and that it is their original work;

b) they own the copyright and any other intellectual property rights of each image;

c) they have the permission of those pictured in the image (or, where the image shows any persons under 18, the consent of their parent/guardian) for the usage rights required by jgallery and will indemnify jgallery against any claims made by any third parties in respect of such infringement;

d) they have not licensed or disposed of any rights in the image that would conflict with uses to be made by jgallery (see #14 ); and

e) they have received any necessary permissions from the owner(s) of buildings included in submitted images for the usage rights required by jgallery in #14 and will indemnify jgallery against any claims made by any third parties in respect of such infringement.

14) By entering the competition, you grant jgallery and its sponsors and supporters a nonexclusive, irrevocable licence to reproduce, enlarge, publish or exhibit, on any media, the images for any purpose connected with the competition. This may include, but is not limited to:

a) display at any exhibitions;

b) on a secure web browser for judging purposes;

c) on the jgallery website and on the websites of sponsors and supporters;

e) for use in press releases to be distributed to national, regional & specialist press giving information about or promoting the competition.

If an image is short-listed, the photographer will be asked to supply an extended caption for that image. This caption will be subject to the terms # 15a and #16.

Entrants also agree that the organisers can sub-license images to the media for reproduction in connection with the competition.

Copyright of each image is retained by its respective photographer.

Finalists agree to take part in post-competition publicity.

15) jgallery reserves the right to remove any entries from the competition that it feels may breach or contravene laws of public decency or may bring the photographer, the competition, Take a view or any of its sponsors into disrepute. Such entries will be deemed as void and any fees paid will not be refunded.

jgallery will remove any entries that appear to have been taken by a member of the public trespassing on the railway network as this is a criminal offence which may lead to prosecution. Such entries will be deemed as void and any fees paid will not be refunded.

16) The decision of the judges is final and no correspondence will be entered into. Should the entries fall below the standard required by the competition organisers and the judges, then the organisers reserve the right not to award prizes.

17) All images must be uploaded, via the jgallery website, following the on-screen instructions. Any queries should be directed toinfo@jgallery.org.uk

18) Refund policy.

By accepting the terms and conditions of the competition and subsequently submitting your images, you have entered into an agreement with jgallery. Once entered, images cannot be withdrawn unless the organisers are notified of a permissions problem, in which case the images will be withdrawn on request of the copyright holder (entrant) but no refund will be payable. If you intend to submit 5 images and pay the fee for this, but then only submit/upload a smaller

number (for example, 2) then you will not be entitled to a refund.

If you feel you are entitled to a refund, you may request this by contacting us. We review all refund requests on a case-by-case basis and reserve the right to decline any refund for any reason.

If a refund is approved, it will be actioned through the payment gateway you paid through. Your refund will be credited to the card you made payment with. You will receive a full refund minus the gateway processing costs.

19) The information given in these Terms and Conditions is correct, but jgallery reserve the right to change any of the above without prior notice. By entering the competition, entrants will be deemed to have agreed to be bound by these Terms and Conditions. Any breach of these Terms by an entrant will void their entry. If a breach has occurred, but is discovered after the award of a prize, then the organisers may request the return of that prize.
